General Purchase Conditions

In compliance with the Spanish Law 34/2002 about Services of the Information Society and Electronic Commerce, ZEVENET S.L. (owner of zevenet.com), hereinafter ZEVENET, informs users that the prices and sales conditions are merely informative and can be modified in response to market fluctuations. However, the completion of the order by completing the purchase form implies compliance with the price offered and the general conditions of sale in force at this particular time. Once the order is formalized, the purchase will be understood as full right, with all the legal guarantees that cover the acquiring consumer, and from that moment the prices and conditions will be contractual, and can not be modified without the express agreement of both contractors. The electronic document in which the contract is formalized will be archived and ZEVENET will make it available to the user whenever it requires it by email.

In the case that the purchase has been made through an official partner or reseller, the conditions detailed here are the same as for a final client.

Shipments and Deliveries

At ZEVENET, the delivery of software products or support services is immediate if they are made through the online store. If they were made by other means, the delivery information will be facilitated at the moment of sending the corresponding invoice or purchase order.

In order to provide fast, safe and reliable shipping of physical products around the world, we have chosen FedEx as the trusted transportation company to deliver to our clients through its International First, International Priority or International Economy services at the client’s choice according to the rate and transit times offered.

We can not guarantee these delivery times, although we try to ensure that the transport companies comply with them whenever possible. In any case, the breach of this transit time is attributable to ZEVENET, and its non-compliance will have to be managed directly with the transport agency.

Due to the particular importation conditions of each country, we can not be held responsible for the expenses caused by customs procedures or delays.

The shipment of physical products may vary between 1 day and 3 weeks depending on the availability and delivery address, although they may never exceed 3 months.

In the case of receiving a product damaged by transport, it is recommendable to contact us as soon as possible. In the same way, it is convenient to leave a record for the transport company.

Returns

At ZEVENET, our goal is that our clients feel comfortable with their purchase. Therefore, you can return the physical products for any reason during the next 10 days from the reception of the same. If you have exceeded these granted days since been received the product, unfortunately, we can not accept a return or exchange.

To be eligible for a return, it must be in the same condition you received it and the final activation certificate (certificate with more than 1 year validity) must not have been issued. It must also be in the original package. To complete your return, we require a receipt or proof of purchase.

In regards to the provision of services, once the service has been completely executed, you will have lost your right to return it back.

Late payment interest

ZEVENET reserves the right to charge “interest of delay” if the customer does not meet the established payment period.

The applicable annual interest will be 8% of the total amount of debt.

Refund

Non-physical products, if certificates of final activation have not been issued (certificate with more than 1 year of validity), the products will be immediately reimbursed. For support services or other types of services such as development, consulting, cloud service, etc., the part corresponding to the time and work carried out so far up to a minimum of 30% of the total budget will be reimbursed.

In the case of physical products, once it is returned and inspected for its correct condition, we will respond with the approval or rejection of the refund. If it has been accepted, then the refund will be processed immediately.

Only products with regular prices may be reimbursed, unfortunately, discounted products may not be subject to reimbursement.

In the case that the refund has caused fluctuations in the price, the amount corresponding to the current price will be calculated, without this implying a loss for ZEVENET.

Repairs

ZEVENET guarantees that its physical products and components thereof are free from defects in handling and materials for a minimum period of 2 years from the date of the invoice. ZEVENET will repair or replace, at its discretion and without additional charge, products or parts of defective components after delivery to the ZEVENET Warranty Service accompanied by proof of the date of the customer’s first purchase, such as a verified warranty or invoice.

Before sending the product for reparation, it is necessary to contact the Warranty Service at support@zevenet.com or through the Support Portal, to verify the hardware defect and ensure the fastest delivery time for reparations.

Certificates

The physical products of ZEVENET meet the essential requirements for the safety of the products and comply with the main standards required by the United States (FCC) and the European Community (EC).

Warranty

All information regarding product warranties can be found in the warranty document that accompanies each product.

Cancellation of Orders

You can cancel hardware product orders as long as the shipment has not been made. For any other non-physical product, the order can be canceled if the definitive activation certificate has not been issued, in a maximum of 30 days from the purchase.

For support services, orders can be canceled as long as the contract for the provision of services has not been sent, after which it must be made by the return policy.

For development or consulting services, the order can be canceled if the first invoice corresponding to the works has not been issued yet.

Responsibility for the Use of Products or Services

In the cases permitted by law, ZEVENET will not be responsible for the loss of profits, income or data, financial losses or indirect, special, derivative, exemplary or punitive damages.

In addition, ZEVENET will not be responsible either for any damage caused by our software as well as damage caused by the misuse of it.

To the extent permitted by law, the total coverage of ZEVENET for any claim related to these conditions, including any implied warranties, is limited to the amount paid by the user for the product or service offered by ZEVENET.

In no case shall ZEVENET be liable for any loss or damage that is not reasonably foreseeable.

If you use the Services or Products on behalf of a company, the company accepts these conditions. ZEVENET, its directors, agents, and employees will be held harmless by claims, demands or legal actions that may derive from the use of the Services or Products or the infraction of these conditions or that are related to them, including any liability or expense arising from claims, losses, damages, claims, lawsuits, procedural costs, and attorneys’ fees.
